Financial Privacy Resources
EPIC maintains in-depth resources on the principal federal financial privacy laws.
The Fair Credit Reporting Act (FCRA) Page discusses the privacy issues involved in credit reporting, employee background checks, and tenant screening. Prescreening, marketing, and law enforcement use of credit information is also included.
The Gramm-Leach-Bliley Act (GLBA) Page discusses the privacy issues involved in financial services--banks, insurance companies, and brokerage houses. The GLBA is also known as the Financial Services Modernization Act, a law that allows limited opt-out of information sharing.
The Right to Financial Privacy Act (RFPA) Page discusses the privacy issues involved with law enforcement access to banking records, and other governmental threats to financial privacy, such as the Suspicious Activity Report.
Other federal laws do contain provisions that may include protection for financial information. These include the Bank Secrecy Act and the IRS Tax Code.
